Formoy is an AI-powered design platform that allows users to create graphics, images, and visual content using artificial intelligence tools. The Service includes features for canvas creation, brand asset management, and AI-generated design elements.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or discriminatory
• Infringe upon intellectual property rights of others

• Generate content depicting minors in inappropriate contexts

5. Intellectual Property

Your Content: You retain ownership of any content you create using the Service. You grant us a limited license to process and store your content solely for the purpose of providing the Service.

AI-Generated Content: You own the rights to content generated by our AI tools, subject to any third-party rights in training data or input materials. We do not claim ownership of AI-generated outputs.

Our IP: The Service, including all software, designs, logos, and trademarks, is owned by PlutoLabs L.L.C and protected by intellectual property laws.

6. Subscription and Billing

Certain features of the Service require a paid subscription. By subscribing:

• You agree to pay all applicable fees as described at the time of purchase
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• No refunds will be provided for partial billing periods

7. Credits System

The Service operates on a credit-based system for AI generation features. Credits are purchased through your subscription plan and expire according to the terms specified at purchase. Unused credits may not be transferred or refunded.

8. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may also terminate your account at any time. Upon termination, your right to use the Service ceases immediately, though we may retain certain data as required by law or for legitimate business purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLUTOLABS L.L.C SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on the Service or sending an email. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
